British Columbia OnSite Sewage Association (“BCOSSA”) has a membership of about 1,000 people who work in the sewage industry. For the most part, these are small operators who are licenced to plan, inspect, install, service and maintain on-site wastewater systems. These would mainly be individual septic systems but would also include small treatment facilities for up to 22,000 litres a day.
BCOSSA members have a number of unique exposures that are difficult insurance placements. These would include design/build Errors and Omissions and Pollution Liability.
Some examples of exposures under General Liability are injury to a person or damage to property while working at a job site. The Completed Operations or resultant damage due to faulty workmanship would also be covered, e.g., breaking a water main causing local businesses to shut down resulting in lost income.
Full Pollution would cover a situation where sewage leaks into a neighbour’s basement or into a fish bearing stream or river and there are clean-up costs involved, plus fines and penalties.
Errors and Omissions coverage for such things as installed systems does not meet the requirements of the Health Act due to a design error.
